The government cannot force healthcare workers to get vaccinated, federal judge rules in favor of the healthcare workers

The government doesn’t have the right to mandate healthcare workers to get vaccinated against Covid-19, federal judge ruled in favor of the healthcare workers who filed the lawsuit against the mandate.

According to the latest decision, while the rule is blocked, the government can’t mandate the healthcare workers to get vaccinated.

Officials with the South Carolina Attorney General’s Office said federal Judge Terry A. Doughty in the U.S. District Court Western District of Louisiana sided with Attorney General Alan Wilson in a lawsuit challenging the mandate.

However, the most recent decision doesn’t apply to private hospitals and private employers who can still mandate their workers to get the shot.

South Carolina Gov. Henry McMaster was happy with the decision and said he will continue the fight against government’s vaccine mandates in the upcoming period. This is what he had to say:

“Another Biden vaccine mandate has been stopped in its tracks by the court,” Gov. Henry McMaster said in a statement. ”The rule of law must prevail. We will continue this fight until no South Carolinian has to choose between the vaccine and their job.”

Fourteen states, including South Carolina, filed lawsuit against president Biden in an effort to stop the vaccine mandate arguing that the president is overreaching his authority for the mandate.

The states that filed the lawsuit against the president argue that the mandate violates the Tenth Amendment, which reserves to the states or to the people any powers not expressly given to the federal government, the attorney general’s office said.

According to Attorney General Alan Wilson, the states that filed the lawsuit are not fighting the vaccines and encourage the public to get vaccinated. He says they are fighting president Biden for not following the law.

“The Biden Administration has struck out in court yet again. That is because the President does not respect the rule of law but only the abuse of power,” Attorney General Wilson said. “Our brave healthcare workers should not be subjected to such overreach by a President who wishes to rule by force.”
